Terms of Service and License Agreement

1. License.

National Law Library provides access to its databases to users based on monthly fees or in partnership with certain web portals. Both the software used to access the data and the arrangement of the data itself belong to Jurisearch Holdings LLC or its affiliates, and their use by users is conditioned on the acceptance of the provisions of this Agreement. By clicking the "I Accept" button at the end of this Agreement, the user acknowledges having read and understood all provisions of this Agreement and agrees to be legally bound by them.

 

2. Use and Limitation.

User understands that this license is for the personal use of user and agrees not to divulge or copy the data provided by National Law Library for any external use in any form to third parties in competition with National Law Library or in any similar business operation, presently existing or contemplated in the future.

 

3. Intellectual Property Rights.

User agrees that certain of the software and content at National Law Library's website, www.itislaw.com, is proprietary to Jurisearch Holdings LLC and might be protected by copyright, trademark, or patent. User agrees that he/she/it will at no time claim any ownership of same by reason of any use under this license nor cause any lien or other interest to exist with respect to any rights granted by this license.

 

4. Limitation of Liability.

National Law Library continually updates the material in its databases to provide its users with the most accurate product possible, but mistakes and computer problems occur from time to time that cannot be avoided. National Law Library therefore makes no warranty or guarantee of accuracy and will not be subject to liability for accuracy or completeness of the information accessed by its users, or for errors or delays or interruption of any data or information stream. Further, National Law Library assumes no liability for problems occurring by reason of a user's software or service provider, or any other cause beyond its control, including acts of God, power and communication failures, or disasters.

 

5. No Warranties.

It is expressly understood and agreed by the parties that National Law Library does not make any warranties with respect to the software or databases, including, without limitation, implied warranties of merchantability or fitness for a particular purpose.

 

6. Indemnification.

User agrees to indemnify National Law Library from all liabilities, expenses, and damages arising out of any willful misuse of the site by user.

 

7. Confidentiality.

User agrees to keep confidential the user identification, password, and any account numbers assigned to him/her/it, and agrees that using the service on more than one computer simultaneously is in violation of this agreement. User agrees to notify National Law Library immediately of any loss, theft, or unauthorized use of such information.

 

8. Applicable law.

Any disputes arising from transactions at or involving this website will be governed by California law. This agreement will be interpreted and enforced in accordance with the laws of California, and the parties agree to the jurisdiction of the courts of California to adjudicate any dispute under this Agreement. Any legal action brought to enforce any right or remedy arising from this agreement must be brought in Los Angeles County, California.

 

9. Termination.

National Law Library reserves the right to change the terms of this License Agreement and to terminate user's access to the data at any time without prior notice if any provision of the license is violated.

 

10. Acceptance.

USER understands that by accepting the terms and conditions of this License Agreement he/she/it is legally bound by its terms.
